  1. Acceptance of Terms

These Terms & Conditions (“Terms”) constitute a legally binding agreement between BuyKenya Business Solutions (“BuyKenya”, “we”, “us”, “Platform”) and you (“User”, “Buyer”, “Seller”).

By accessing or using BuyKenya.biz, you agree to comply with and be bound by these Terms, together with our Privacy Policy, Safety Policy, and Refund Policy.

If you do not agree, you must not use the Platform.

  1. Nature of the Platform

BuyKenya.biz is an e-commerce platform that enables:

  • Buyers to discover and purchase products from verified sellers
  • Sellers to list, promote, and sell products
  • Secure payments through an escrow system
  • Coordinated delivery through an integrated logistics layer

BuyKenya provides the infrastructure to facilitate transactions but does not own the goods listed.

  1. Role of BuyKenya

BuyKenya:

  • Facilitates transactions between buyers and sellers
  • Processes payments via secure payment channels
  • Holds funds in escrow until delivery is confirmed
  • Coordinates logistics and order fulfillment

However:

  • BuyKenya does not manufacture or own listed products
  • Product quality and accuracy remain the responsibility of the seller
  • BuyKenya enforces compliance through platform controls and dispute resolution mechanisms
  1. Account Registration
  • Users must create an account to access key features
  • You agree to provide accurate and complete information
  • You are responsible for maintaining the confidentiality of your account
  • BuyKenya reserves the right to suspend or terminate accounts for violations
  1. Orders, Payments & Escrow
  • All payments must be made through BuyKenya.biz
  • Accepted payment methods include:
    • M-Pesa
    • Visa
    • Mastercard

Escrow System

  • Payments are held in a secure escrow wallet
  • Funds are only released to the seller when:
    • Delivery is confirmed by the buyer, OR
    • No dispute is raised within the allowed timeframe

BuyKenya may delay or withhold payments in cases of disputes, fraud checks, or policy violations.

  1. Fees, Commission & Pricing
  2. a) Platform Commission
  • BuyKenya charges a 6% transaction commission on the Seller for each completed order
  • This commission is automatically deducted from the Seller’s payout from escrow before funds are released
  1. b) Logistics & Delivery Costs
  • Delivery (logistics) costs are fully borne by the Customer (Buyer)
  • Delivery fees are calculated based on:
    • Distance
    • Package size/weight
    • Delivery location
  • The total delivery fee is displayed at checkout before payment is completed
  1. c) Payment Processing
  • Payments are processed through a secure unified gateway
  • Any applicable processing or service fees are included in the final checkout amount where applicable
  1. Delivery & Fulfillment
  • Orders are fulfilled through BuyKenya’s logistics coordination system
  • Delivery timelines:
    • Nairobi: within 24 hours
    • Nationwide: 48–72 hours

BuyKenya is not liable for delays caused by:

  • Incorrect delivery information
  • External factors beyond reasonable control
  1. Refunds & Disputes

Refunds and disputes are governed by the BuyKenya.biz Refund Policy.

  • Customers must report issues within the specified timeframe
  • BuyKenya will review and determine appropriate resolution
  • Refunds may be processed from escrow or enforced on sellers

BuyKenya reserves the right to make final decisions on disputes, subject to applicable law.

  1. Seller Obligations

Sellers agree to:

  • Provide accurate product descriptions and pricing
  • Fulfill orders promptly
  • Deliver goods in acceptable condition
  • Comply with all applicable laws and regulations

Failure to comply may result in:

  • Refund enforcement
  • Account suspension or termination
  1. Buyer Responsibilities

Buyers agree to:

  • Provide accurate delivery information
  • Complete payments through the platform
  • Pay applicable delivery (logistics) fees
  • Confirm delivery upon receipt
  • Report issues within the allowed timeframe
  1. Prohibited Activities

Users are prohibited from:

  • Engaging in fraudulent transactions
  • Circumventing the escrow/payment system
  • Listing illegal or prohibited items
  • Misrepresenting identity or products

Violation may result in immediate account suspension, termination, and possible legal action.

  1. Intellectual Property
  • Users retain ownership of their content but grant BuyKenya a license to use it for platform and marketing purposes
  • All platform content, systems, and branding belong to BuyKenya
  • Unauthorized use is prohibited
  1. Limitation of Liability

To the extent permitted by law:

  • BuyKenya shall not be liable for indirect, incidental, or consequential damages
  • Total liability shall not exceed the total transaction value or KSh 10,500, whichever is lower
  1. Indemnity

You agree to indemnify and hold harmless BuyKenya, its affiliates, and employees from any claims arising from:

  • Your use of the Platform
  • Your transactions
  • Your violation of these Terms
  1. Governing Law & Dispute Resolution

These Terms are governed by the laws of Kenya.

Any disputes shall be resolved through arbitration under the NCIA Arbitration Rules, conducted in English.

  1. Changes to Terms

BuyKenya reserves the right to update these Terms at any time.

Continued use of the Platform after changes constitutes acceptance of the revised Terms.
